課程內容概述Course Description

本課程係介紹雅典民主政治最重要的機制：法庭，以及法律與實踐之間的關係。雅典法庭是護衛雅典城邦（polis）、人民（demos）以及民主政治（demokratia），來對抗豪強貴族的欺凌，進而藉由法庭機制主宰雅典政治發展。這群演說詞史料除了對瞭解四世紀成熟雅典民主政治極為關鍵之外，也是瞭解雅典社會、經濟以及心理史最重要的素材。本課程雖然在介紹時會強調其政治背景，但在討論議題時，則多以社會、經濟及心理方面為主。

課程學習目標Course Goal

本課程希望介紹修課同學瞭解以下幾件重要議題：

（1）    雅典城邦做為論述空間（discursive space）中logos的重要性以及如何經營logos之修辭學的運用。

（2）    雅典民主政治以及法庭之間的關係；從人民及城邦觀點來看對蘇格拉底的審判。

（3）    雅典法庭演說詞所提及之諸項社會議題，以及親自體會雅典人如何透過訴訟以及公民仲裁，以和平方式來解決糾紛。

（4）    透過上述諸點的探索，我們有機會來反省我們所在之自由主義傳統民主政治的特色及限制。
